NOW!! Terms of Service

This Membership Agreement (hereinafter referred to as the "Terms") defines the conditions for using the real-time mutual aid and communication service utilizing location information provided by NOW!! (hereinafter referred to as the "Service"). Please read the following content carefully and agree to these Terms before using the Service.

Article 1 (Application)

1. These Terms shall apply to all relationships between the user and the operator of the Service (hereinafter referred to as the "Operator") regarding the use of the Service.

2. Rules, guidelines, and precautions posted by the Operator on the Service shall constitute a part of these Terms.

Article 2 (Service Content)

The Service is an SNS platform that utilizes location information to support real-time communication and mutual assistance (mutual aid) between nearby users (within a radius of approximately 3km) and paired partners. Users may utilize the following functions through the Service:

1. Sending and receiving status notifications (greetings such as "Now!!") to convey current situations or feelings.

2. Posting and sharing content such as images, text, and links to external SNS accounts.

3. Notifying nearby users and requesting assistance in emergencies ("Emergency Mode" such as "I'm in trouble!!").

4. Promoting interaction between users through anniversary matching, such as birthdays.

Information, images, and the content of external SNS links shared on the Service are the sole responsibility of the user who posted them. The Operator does not guarantee the accuracy, completeness, safety, or fitness for a particular purpose of such content.

Article 3 (Prohibitions)

Users shall not engage in the following acts when using the Service:

1. Providing or registering false information.

2. Impersonating others to use the Service.

3. Posting inappropriate content (sexual, violent, defamatory, or contrary to public order and morals).

4. Misusing emergency notifications (e.g., "I'm in trouble!!") or making false requests for assistance.

5. Using the Service's location information for stalking, ambushing, or harassing others.

6. Using the Service for publicity, advertising, solicitation, or business activities without the Operator's permission.

7. Acts that encourage or induce criminal or illegal activities.

8. Any other acts deemed inappropriate by the Operator.

Article 4 (Fees and Payment Methods)

1. The paid plans and usage fees for the Service shall be in accordance with the prices (e.g., 110 JPY, 330 JPY) presented within the app or on the official website.

2. Paid plans include benefits such as relaxation of image attachment limits and unlimited posting of SNS links.

3. Users shall pay the prescribed fees in advance using the payment methods designated by the Operator (e.g., Stripe).

4. Due to the nature of the Service, no cancellations or refunds will be accepted after the payment is completed.

5. For continuous plans of 7 days or more (30-day, 1-year plans, etc.), separate discounts (e.g., pair discounts) or benefits may apply.

Article 5 (Disclaimer and Limitation of Liability)

1. The Operator makes no warranties regarding the accuracy, truthfulness, currency, or usefulness of the location information, content, and interactions between users provided in the Service.

2. The Service provides a platform to support communication and mutual aid between users; the Operator does not guarantee direct rescue, assistance, or resolution of disputes.

3. As the accuracy of location information depends on the user's device, communication environment, and GPS satellite status, the Operator does not guarantee complete accuracy and assumes no responsibility for damages resulting from discrepancies in information.

4. Any troubles, disputes, or damages occurring between users or between a user and a third party shall be resolved at the user's own responsibility and expense. The Operator shall not be involved in or responsible for such matters.

5. The Operator shall not be liable for any damages caused to the user due to the interruption, suspension, termination, unavailability, or change/deletion of information of the Service.

Article 6 (Suspension and Termination of Service)

1. The Operator may interrupt or suspend the provision of all or part of the Service without prior notice to the user in any of the following cases:

   • When performing urgent maintenance, inspection, or repair of servers, communication lines, or systems.

   • When service provision becomes difficult due to force majeure such as fire, power failure, or natural disasters.

   • When there is a request for suspension based on laws, administrative guidance, or orders from public institutions.

   • When the Operator deems interruption or suspension necessary for other reasons.

2. The Operator may terminate the provision of the Service at its discretion. In this case, the Operator shall provide prior notice within a reasonable period.

3. The Operator shall not be liable for any damages caused to the user due to the suspension or termination of the Service based on this Article. In principle, no refunds will be made for unused portions of fees.

Article 7 (Intellectual Property Rights)

1. All intellectual property rights related to the Service, including text, logos, designs, systems, and software, belong to the Operator or the respective right holders.

2. The copyright of the content (images, text, etc.) posted by users on the Service belongs to the user or the original right holder. However, the user grants the Operator a royalty-free, perpetual right to use (reproduce, adapt, publicly transmit, etc.) such content for the purpose of providing, maintaining, improving, and promoting the Service.

Article 8 (Governing Law and Jurisdiction)

1. The laws of Japan shall be the governing law for the interpretation and application of these Terms.

2. In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Operator (e.g., Tokyo District Court) shall be the exclusive agreement jurisdictional court of the first instance.

3. In the event that these Terms are translated into multiple languages, and there is a discrepancy or contradiction between the translated version and the Japanese version, the content of the Japanese version shall always prevail.
